Temporary Protected Status (TPS) is a humanitarian immigration program, created by Congress in 1990, that allows nationals from countries experiencing armed conflict, environmental disasters, epidemics, or other crises to stay and work legally in the U.S. during a designated period.
Key features:
- Provides legal stay temporarily and protection from deportation.
- Recipients receive Employment Authorization Documents (EADs) to work lawfully
- TPS does NOT lead directly to permanent residency or citizenship
Who’s Currently Under TPS?
As of mid‑2025, approximately 1 million TPS holders live in the U.S. Major countries currently designated include:
- El Salvador – through September 9, 2026
- Syria, Sudan, South Sudan – through late 2025 or 2026
- Yemen, Myanmar, Ukraine, Venezuela – various end dates from late 2025 to 2026
Studies show high workforce participation among TPS holders, 87% of Salvadorans and 81% of Hondurans, contribute to the labor force, benefiting U.S. industries.
Recent & Upcoming TPS Expirations
Honduras & Nicaragua
On July 7, 2025, the U.S. government announced the end of TPS for Honduras and Nicaragua, effective July 5, 2025, with a 60-day wind-down period. Work permits (EADs) will remain valid through early September 2025 but must be reverified as of Sept 9, 2025.
Haiti
TPS for Haitians is ending on September 2, 2025. A federal ruling temporarily maintains status through that date.
Venezuela and Others
TPS protections for Venezuela and others remain valid longer. Venezuelans are authorized through October 2, 2026 (pending litigation).
Why Employers Need to Pay Attention Now
Many warehousing, manufacturing, logistics, food service, and facility sectors rely heavily on TPS-authorized employees. Without advance planning, companies could face:
- Major staffing disruptions,
- Compliance and legal risk,
- And escalated cost pressures just before peak season.
Workforce Risk
When TPS-designated EADs expire and TPS ends, typically after a 60-day transition, recipients with no other status must stop working. This can cause sudden labor shortages, especially in sectors relying on TPS-holders.
Compliance Imperatives
All employees must be reverified for Form I‑9 once TPS expires. Employers must E‑Verify new hires, keep records updated, and avoid fines for noncompliance E-Verify.
Turnover & Training Burden
Replacing suddenly unavailable staff creates hidden costs — recruitment, training, productivity losses, and potential disruptions.
What You Can Do: Proactive Strategies
- Audit your workforce now: Identify employees with TPS-based EADs, especially from Haiti, Honduras, and Nicaragua.
- Prepare for late‑summer transitions: Key expiry dates: Sept 2, 2025 (Haiti) and Sept–Oct 2025 (Honduras/Nicaragua).
- Use E-Verify processes: Implement E-Verify on all new hires.
- Have a backfill plan: Investigate temporary staffing, surge pools, and compliance training to maintain operations.
